By placing an order, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and that the information you provide is accurate and complete. We reserve the right to refuse service to anyone at our sole discretion.

3. Products & Descriptions

All jewelry sold on Diavlia features certified fines and/or precious gemstones. Product images are representative; slight variations in color, size, and appearance may occur due to monitor settings and the unique nature of each piece. All diamonds are graded and certified by independent gemological laboratories. We make every effort to display colors and images accurately, but we cannot guarantee that your device's display will reflect the exact color of the product.

4. Pricing & Payment

All prices are listed in the currency displayed at checkout and include applicable taxes unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors, even after an order has been placed. In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel your order for a full refund.

Payment must be made in full at the time of purchase. We accept major credit cards, PayPal, and other payment methods as displayed at checkout. All transactions are processed through PCI DSS-compliant payment providers.

5. Orders & Cancellations

An order confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel orders for any reason, including suspected fraud, product unavailability, or pricing errors. If your order is cancelled, you will receive a full refund. Orders may be cancelled by you within 24 hours of placement, provided the order has not yet been shipped.

6. Shipping & Delivery

Shipping times and costs are estimated at checkout and vary by destination. We are not responsible for delays caused by customs, weather, carrier issues, or other circumstances beyond our control. 12. Dispute Resolution

In the event of any dispute arising from these terms or your use of our website, you agree to first attempt to resolve the dispute informally by contacting us at info@diavlia.com. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) in Albuquerque, New Mexico, under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator, and the decision shall be final and binding.

Class action waiver: You agree that any dispute resolution will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of New Mexico, USA, without regard to its conflict of laws principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Bernalillo County, New Mexico.

14. Force Majeure

Diavlia shall not be liable for any delay or failure to perform obligations under these terms resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, acts of government, supply chain disruptions, shipping delays, or technical failures.

15. Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
